PART 3A APPLICATIONS
Projects that are considered of regional or State environmental planning significance are determined by the Minister for Planning under Part 3A of the Environmental Planning and Assessment Act 1979. The types of development that may be declared a Part 3A project are set out in Schedule 1 of State Environmental Planning Policy (Major Development) 2005 and include:
- agriculture, timber, food and related industries
- mining, petroleum production, quarries and associated processing industries
- chemical, manufacturing and related industries
- general manufacturing, distribution and storage facilities
- residential, commercial or retail projects
- tourism and recreational facilities
- health and public services facilities
- transport communications, energy and water infrastructure
- resource and waste related industries
Scheudle 1 also sets thresholds to be reached before a proposal may be considered a major project. For residential, commercial and retail projects, this threshold is that such projects must have a capital investment value of more than $100 million and not be proposals that would be considered by the Central Sydney Planning Committee located in the City of Sydney LGA.
The application for a major project must be accompanied by an Environmental Assessment, addressing issues as required by the Director-General of the Department of Planning.
